What Is an Uncontested Divorce in New York?


In New York, a divorce is considered uncontested when both spouses reach a full agreement on all major issues, including:

Most uncontested divorces in New York are filed under the no-fault ground of “irretrievable breakdown of the marriage” for at least six months (Domestic Relations Law § 170(7)). Notably, only one spouse needs to affirm this, meaning the other cannot contest the breakdown itself.
